The Council of Ministers has approved the Royal Decree on urgent economic measures, which includes the extension of the extraordinary limitation of the annual update on the rent of housing rental contracts that prevents the rise of more than 2%.
Through this measure, it is established that the lessee of a rental contract, from the effective date of this Royal Decree until December 31st, 2022, may negotiate with the lessor the increase applied to the rent. The rise in the contract update may not exceed 2% determined by the Competitiveness Guarantee Index.
The extension of the limitation avoids the usual application of the Consumer Price Index (CPI) in the update of the rental; and it establishes the need for an agreement to be reached between the tenant and the lessor, or the increase in accordance with the Guarantee Index is fulfilled of Competitiveness that is into force.
With this regularization, it is about applying an urgent measure within the structural measures of the area of Architecture and Housing of the Government. With special attention to the increase in the CPI in the context of the economic and social consequences of the war in Ukraine, to try not to increase the housing rental price.
